California Termite Inspection Laws

Termites severely damage wood so houses must be regularly inspected.


Because termites pose such a threat to the structure of a home over time, many states require termite inspections when someone buys a home. California has laws governing the required termite inspections of all residences throughout the state.


Chemicals Used


The chemicals that may be used in termite and other pest fumigation include methyl bromide, sulfur dioxide, aluminum phosphide, propylene oxide and sulfuryl flouride. A warning chemical--chloropicrin--must also be used simultaneously with the fumigants in order to signal the presence of dangerous chemical.


Administering the Inspection


Only a licensed pest control company can administer termite inspections and treatment. All properties to be inspected must be completely vacated before the inspection begins. A notice of the date and place of fumigation and the chemicals used must be given to the local fire department. The location being fumigated must also be sealed by the licensed professional. Warning signs (reading "DANGER-FUMIGATION") must also be placed around the location. Another letter giving the date and place, name of the pest control company and chemicals used must be posted in the attic or basement of the structure.


Laws Concerning Pest Control


A registered pest control company cannot charge a homeowner for services that are not actually performed by the company. No fumigation work can be done on a building until a full inspection has been conducted. A registered company must have a valid, current license and cannot perform any services, handle any chemicals or authorize any work without a license. Fines and possible jail time are the consequences that follow from confirmed violations.


Pest Control Education and Enforcement Fund


Funds collected from the pesticide use report filing fee from pest control companies are to be used towards the Pest Control Education and Enforcement Fund. This fund provides training to pest control operators, reimburses the Director of Pesticide Regulations for cost of work performed and expenses incurred by the Disciplinary Review Board.
