Repay an Insurance Claim


A claim paid by an insurance company to an individual or policy holder for medical care, auto collision, home repairs often may have to be repaid. Such instances include but are not limited to medical attention or therapy, auto body or mechanical repairs, or home repairs that are initially paid by an insurance claim but are taken over by a judgment or settlement. In some cases, the insured or injured party may have to reimburse an insurance company for claims already paid or collected.


Instructions


1. Contact the insurance company in writing and verify the repayment amount of the claim and the veracity for which the claim is to be repaid. Include all contingent aspects and extraordinary circumstances as well as an election to negotiate a settlement amount.


2. Negotiate the repayment amount based on the settlement or judgment amount. State laws vary, but in general, insurances companies are entitled to partial repayment of paid claims. Contact the insurance company once the notice of claim repayment is received and offer an amount equal to 25 percent to 50 percent of the demand.


3. Obtain a certified check for the agreed negotiated amount and mail it via U.S. Postal Service Certified Mail to the insurance company. Include a letter detailing the amount, agreement between parties and keep a copy for your records.
